السلامُ علیکم و رحمۃ اللہ و برکاتہ

انوکھا مقدمہ
سعودی عرب کے شہر قصیم کی شرعی عدالت نے اپنی تاریخ میں ایسا عجیب و غریب مقدمہ دیکھا جو کہ قصیم   بلکہ پوری مملکت سعودی عرب میں نا ہی پہلے کبھی دیکھا یا سنا گیا تھا۔۔۔

ہم آئے دن خاندانی اختلافات، قطع رحمی اور عناد کی بھینٹ چڑھنے والے افسوس ناک واقعات اور دلوں کو لرزا دینے واقعات کی تفاصیل تو پڑھتے، سنتے اور دیکھتے ہی رہتے ہیں مگر صلہ رحمی کی بنیاد پر بننے والے اس مقدمہ کی تفاصیل سنیئے اور اس واقعہ کو کسوٹی بنا کر اپنے آپ کو یا اپنے گردو نواح میں وقوع پذیر حالات و واقعات کو پرکھیئے۔۔۔

اس شخص کا نام حیزان الفہیدی الحربی ہے۔ یہ بریدہ سے 90 کلومیٹر کے فاصلے پر واقع ایک گاؤں (اسیاح) کا رہنے والا ہے۔ قصیم کی شرعی عدالت میں فیصلہ جیسے ہی اس کے خلاف گیا تو اس نے خود تو رو رو کر اپنی داڑھی کو آنسوؤں سے تر بتر کیا ہی، مگر اس کو دیکھنے والے والے لوگ بھی رو پڑے۔

آخر کس بات پر یہ زاروقطار رونا اور غش پڑ پڑ جانا؟ اولاد کی بے رخی؟ خاندانی زمین سے بے دخلی؟ حیزان کی بیوی نے اُس پرخلع کا دعویٰ کیا؟ نہیں، ایسا تو کچھ بھی نہیں ہوا تو پھر آخر کس بات کا رونا!! یہ قصہ تصوراتی نہیں بلکہ سچا اور حقیقت پر مبنی ہے جس کی تفاصیل سعودی عرب کے ایک بڑے اخبار (الریاض) کے سرورق پر چھپیں،   مملکت کی کئی بڑی مساجد کے منابر سے آئمہ کرام نے اپنے خطابات میں اس واقعے کا ذکر کیا،  سینکڑوں عربی ویب سائٹس اور فورمز پر لوگوں کی آنکھیں کھولنے والے اس واقعہ کی تلخیص آپ کیلے حاضر ہے۔

حیزان اپنی ماں کی بڑا بیٹا ہے، اکیلا ہونے کی وجہ سے سارا وقت اپنی ماں کی خدمت اور نگہداشت پر صرف کرتا تھا۔ حیزان کی ماں   ایک بوڑھی اور لاچار عورت جس کی کل ملکیت پیتل کی ایک انگوٹھی، جسے بیچا جائے تو کوئی سو روپے بھی دینے پر نا آمادہ ہو۔

سب کچھ ٹھیک جا رہا تھا کہ ایک دن دوسرے شہر سے حیزان کے چھوٹے بھائی نے آکر مطالبہ کر ڈالا کہ میں ماں کو ساتھ لے کر جانا چاہتا ہوں تاکہ وہ شہر میں میرے خاندان کے ساتھ رہ سکے۔ حیزان کو اپنے چھوٹے بھائی کا اس طرح آکر ماں کو شہر لے جانے کا ارادہ بالکل پسند نا آیا، اس نے اپنے بھائی کو سختی سے منع کیا کہ وہ ایسا نہیں کرنے دے گا، ابھی بھی اس کے اندر اتنی ہمت ، سکت اور استطاعت ہے کہ وہ ماں کی مکمل دیکھ بھال اور خدمت کر سکتا ہے۔

دونوں بھائیوں کے درمیان تو تکار زیادہ بڑھی تو انہوں نے معاملہ عدالت میں لے جانے کا فیصلہ کیا گیا، مگر معاملہ عدالت میں جا کر بھی جوں کا توں ہی رہا، دونوں بھائی اپنے موقف سے دستبردار ہونے پر آمادہ نہیں ہوتے تھے اور عدالت پیشیوں پر پیشیاں دیتی رہی تاکہ وہ دونوں کس حتمی نتیجے پر پہنچ سکیں۔ مگر یہ سب کچھ بے سود رہا۔

مقدمے کی طوالت سے تنگ آ کر قاضی نےآئندہ پیشی پر دونوں کو اپنی ماں کو ساتھ لے کر آنے کیلئے کہا تاکہ وہ اُن کی ماں سے ہی رائے لے سکے کہ وہ کس کے ساتھ رہنا زیادہ پسند کرے گی؟

اگلی پیشی پر یہ دونوں بھائی اپنی ماں کو ساتھ لے کر آئے، اُنکی ماں کیا تھی محض ہڈیوں کا ایک ڈھانچہ، جب قاضی نے اُنکی ماں کو پیش ہونے کیلئے کہا تو وہ اُسے ایک خالی کارٹون میں ڈال کر لائے ، بڑھیا کا وزن بیس کلو بھی نہیں بنتا تھا۔

قاضی نے بڑھیا سے پوچھا کہ کیا وہ جانتی ہے کہ اُس کے دونوں بیٹوں کے درمیان اُسکی خدمت اور نگہداشت کیلئے تنازع چل رہا ہے؟ دونوں چاہتے ہیں کہ وہ اُسے اپنے پاس رکھیں! ایسی صورتحال میں وہ کس کے پاس جا کر رہنا زیادہ پسند کرے گی؟

بڑھیا نے کہا، ہاں میں جانتی ہوں مگر میرے لیئے کسی ایک کے ساتھ جا کر رہنے کا فیصلہ کرنا بہت مشکل ہے۔ اگر حیزان میری ایک آنکھ کی مانند ہے تو اسکا چھوٹا بھائی میری دوسری آنکھ ہے۔

قاضی صاحب نے معاملے کو ختم کرنے کی خاطر حیزان کے چھوٹے بھائ کی مادی اور مالی حالت کو نظر میں رکھتے ہوئے مقدمے کا فیصلہ اُس کے حق میں کر دیا۔

جی ہاں، تو یہ وجہ تھی حیزان کے اس طرح ڈھاڑیں مار مار کر رونے کی۔ کتنے قیمتی تھے حیزان کے یہ آنسو! حسرت کے آنسو ، کہ وہ اپنی ماں کی خدمت کرنے پر قادر کیوں نہیں مانا گیا؟ اتنا عمر رسیدہ ہونے کے باوجود بھی ماں کی خدمت کرنے کو سعادت حاصل کرنے کیلئے یہ جدوجہد؟ شاید بات حیزان کی نہیں، بات تو اُن والدین کی ہے جنہوں نے حیزان جیسے لوگوں کی تربیت کی اور اُنہیں برالوالدین کی اہمیت اور عظمت کا درس دیا۔
